Policy and Research Division (BDP) has been established since the beginning of the establishment of the Department of Syariah Judiciary Malaysia (JKSM) in December 15, 1998. In the early years, the BDP known as the Research Branch before the change to the Policy and Research Division on 16 February 2008.

There are 16 positions in various grades in the BDP. 13 posts have been filled and the remaining 3 are still vacant.

BDP is headed by the Director, Shariah Officer Grade LS48 responsible to the Senior Director of Justice. Director aids by 6 Senior Assistant Director (Grade LS 44) and 1 Assistant Director (Grade LS 41). Support positions are filled by 4 Shariah Assistant (Grade LS 27), 2 Shariah Assistant (Grade 17) and 2 Assistant (grade N 17).

The functions of Policy and Research Division

1. Conducting research on the Syariah Court affairs, statistics, trial proceedings and judgment of the Syariah Court.
2. Issue the latest information on the progress of Shariah Law which are applicable in the Syariah Court.
3. Assist on writing articles related to the law and the judiciary.
4. Collaborate with research centers and government agencies, higher education centers and other programs related to legal studies and judiciary.
5. Conduct research on Islamic legal affairs in National and International level.
6. Refine existing Shariah law and implement in the Syariah Court to make it more effective and efficient.
7. Conducting research related to the translation of reference materials in Malay. BDP is divided into two main sections:

  i. Research and Shariah Law Section , and
ii. Syariah Court Affairs Research Section

 

 

Research and Shariah Law Section is divided into four units:

  • Rules and Regulations of the Syariah Court Research Unit, headed by Senior Assistant Director LS 44.
  • Procedure and Evidence of the Syariah Court Research Unit, headed by Senior Assistant Director LS 44.
  • Ahwal Syakhsiah and the Syariah Criminal Research Unit, headed by Senior Assistant Director LS 44.
  • International Relations Affairs Research Unit, headed by Senior Assistant Director LS 44.

 

 

Syariah Court Affairs Research Section is divided into three units:

  • Human Resource Development Research Unit, headed by the Assistant Director of the LS 41.
  • Development Needs of Syariah Court Research Unit, headed by senior assistant director LS 44.
  • Syariah Court Case Management Research Unit, headed by Senior Assistant Director LS 44.

 

 

The Function of Law and Shariah Research Section:

  • Conducting research related to shariah and law involving administration of Syariah Court justice either nationally or internationally.
  • Provide legal research inputs and legal issues related to Islamic law and jurisprudence.
  • Provide information, advice or opinion to the Department and other agencies in respect of any legal issues and shariah.

 

 

The Function of Syariah Court Affairs Research Section:

  • Conducting research on issues of management and administration in the Syariah Court.
  • Provide inputs findings related to administrative and management issues in the Syariah Court.
  • Provide information, advice or opinion to the Department and other agencies on the administration and case management issues in the Syariah Court.
